Freddy Mieryteran faces several charges for his alleged involvement in the fatal DUI car crash that caused the death of Annie Becerra of Southwest Miami-Dade.
Mieryteran, 21, is awaiting trial for DUI manslaughter, leaving the scene of a fatal crash, and several other felonies. It is unclear if he has acquired the services of an attorney.
According to Miami-Dade police, the alleged car crash occurred east on Kendall Drive on the night of November 30, 2018. Mieryteran was driving a Nissan Versa and Becerra, 23, was his front passenger. Mieryteran reportedly ran a red light at SW 122nd Avenue and crashed into BMW 3201 that was driving through the intersection.
After the crash, Mieryteran reportedly ran away from the scene but was found hiding in some bushes nearby by authorities. According to the Florida Highway Patrol troopers who arrived at the scene, Mieryteran never told them that someone else was in the vehicle.
“He never mentioned the victim having been in the vehicle with him, nor did he mention she was wedged in the front passenger floorboard under the glove box,” according to the police report.
As a result, over an hour purportedly passed before Becerra was found. She wasn’t noticed until a trooper started doing an inventory of the crash scene. She was pulled out of the wreckage with a severe head injury and was rushed to Kendall Regional Medical Center, where she was pronounced dead a few days later.
Becerra’s family are reportedly suing the Miami-Dade Police Department, Florida Highway Patrol, and Miami-Dade Fire Rescue for negligence. According to the lawsuit, there were at least four officers at the scene, but Becerra wasn’t found for an hour and 15 minutes, and that might have cost her her life.
The first trooper who arrived at the scene, identified as Kyle Viveiros, started interviewing witnesses and didn’t see Becerra. He reportedly noticed that Mieryteran’s vehicle smelled of marijuana and found several empty bottles of beer inside the car.
Paramedics were called to the scene only after Mieryteran started complaining about pain. It was soon after that Viveiros reportedly found Becerra.
When questioned by police later in the night, Mieryteran reportedly said the car was a rental and that the traffic light was yellow when he drove through the intersection. He allegedly insisted that he had dropped off Becerra at her home before the crash.
Mieryteran also insisted that he hadn’t been drinking and a blood-alcohol test taken four hours after the crash showed that he had a legal amount of alcohol in his system to be driving. However, the test also revealed that he had heavy doses of Xanax, marijuana, and cocaine in his system.
