Axel Rojas Hernandez of Miami was arrested on June 25 for allegedly driving a vehicle while drunk and crashing into two parked cars.
Hernandez, 21, is being charged with DUI and DUI causing property damage. The press did not name an attorney for him.
According to the arrest report, the alleged incident occurred just before 4 a.m. on Monday. Hernandez was driving in the 500 block of 15th Street with three passengers when he crashed into two parked cars. Hernandez’s car flipped over after the collision, but no serious injuries were reported. One of the passengers was taken to Jackson Memorial Hospital for treatment.
The deputy who responded to the crash said Hernandez had slurred speech, bloodshot eyes, and smelled of alcohol. He described Hernandez’s behavior as “incoherent,” the report said. The 21-year-old told the officer that he was the driver and he had the car keys.
Hernandez failed a series of field sobriety exercises at the scene of the crash. He agreed to take a breath test at the police station and the results showed that his blood alcohol content was 0.120, which is above the legal limit of 0.08.
Another DUI case was reported in Miami-Dade two weeks ago. Ricardo Gonzalez, 25, was arrested and charged with DUI manslaughter, leaving the scene of a crash involving a death, vehicular homicide, and attempting to tamper with physical evidence. The press did not say if he has hired an attorney.
According to the arrest affidavit, Gonzalez surrendered to police officers at a restaurant on Flagler Street. He confessed to the hit-and-run crash and told police how he ran down Hilda Garcia, 77, as she was crossing NW 37th Avenue and attempted to cover up the crime.
Gonzalez said he was driving 40 to 45 mph on a 35 mph zone with a broken headlight. He knew he struck something because there was a 4-inch hole in his windshield, but he didn’t stop because he feared for his life.
The following day, Gonzalez sold his vehicle to a junkyard in an attempt to hide the evidence. He got $200 for his vehicle, which was crushed and sold as scrap metal to a business in Georgia, the report said.
Gonzalez also reportedly admitted that he was high on marijuana at the time of the crash.
“He also stated when he smokes marijuana, his left eye closes due to his lazy eye,” the report said. “When asked if he felt any effects from the marijuana cigarette, he stated that he felt buzzed, but was fine to drive because he has always driven buzzed and has never hit anyone before.”
DUI charges carry serious penalties. The Florida legislature has passed stringent DUI laws because of all the horrible deaths, particularly of young people, that have been caused by drunk driving. The Florida Highway Patrol and local police departments are required to enforce these laws with a zero tolerance standard.
