Mental health technician Christian Vidal of Miami, Florida was arrested on May 22 for allegedly sexually battering a patient at Mount Sinai Medical Center in Miami Beach.

Vidal, 42, was charged with sexual battery. He was released on $10,000 bond. The press did not name an attorney for him.

According to the police report, the alleged battery occurred on November 5 at Mount Sinai Medical Center. The alleged victim was reportedly placed in the hospital under the Baker Act. Vidal allegedly went to her room and kissed her right breast. He then licked his fingers and touched her vagina.

The victim reported the incident immediately after it happened to hospital staff, who informed authorities. The statement she gave the police reportedly matched the one she gave hospital staff. She was taken to Roxcy Bolton Rape Treatment Center at Jackson Memorial for examination.

Vidal went to the police station to give a statement. He reportedly told investigators that he went to the alleged victim’s room to give her a remote control. He agreed to provide investigators with a DNA sample, the report said.

Vidal’s DNA sample and the victim’s rape kit were sent to the Miami-Dade Police Forensic Services Bureau for analysis. The results recently came back and Vidal’s DNA matched the DNA found in the rape kit, police said. That led to Vidal’s arrest on a sexual battery charge last week.

“Mount Sinai’s top priority is the safety of our patients, visitors and employees,” the hospital said in a statement, according to Local 10 News. “Mount Sinai Medical Center cannot comment on matters regarding patient privacy, ongoing investigations and legal proceedings. To the extent that we are aware of an incident, the appropriate authorities (were) contacted immediately and have our full cooperation. Our relationship with the Miami Beach Police Department and all first responder teams across the country is without parallel.”

Sexual battery is one of the most aggressively prosecuted crimes in Florida and it carries severe penalties. Under Florida statutes, sexual battery occurs when a person has non-consensual sexual contact with someone using their sex organ or an object.

The penalties for sexual battery are determined by the age of the victim, the age of the offender, or the presence of aggravating circumstances. The crime is a second degree felony punishable by up to 15 years in prison, 15 years of sex offender probation, and a $10,000 fine. A person convicted of the charge will also be registered as a sex offender and must comply with sex offender laws for the rest of their lives.
