Under Florida law, possession of child pornography is a third-degree felony. Sharing and promoting or producing of child pornography are much more severe offenses. Those convicted of possession of child pornography could face a mandatory prison term of up to 20 years for each offense. Penalties also include heavy fines and a lifetime registration in the National Sex Offender Registry.
Sharing child pornography with another person can upgrade an offender’s charge to a second-degree felony, which is punishable by up to 15 years in prison. Promoting and producing child porn carries the most severe penalties. It can upgraded to a first-degree penalty, punishable by up to 30 years in prison.
Both state prosecutors and law enforcement officials make a point to ensure anyone suspected of or charged with a sex offense involving a child is prosecuted to the fullest extent of the law. Because of the life-changing consequences of a conviction, it is extremely important to hire an experienced attorney who can guide you through the criminal justice system.
